THE HIGH COURT LAWYERS WELFARE FUNDS RULES, 2008.

 

SECTION :- 1 SHORT TITLE AND COMMENCEMENT:- High Court Lawyers Welfare Fund Rules, 2007 are now rechristened as THE HIGH COURT LAWYERS WELFARE FUND RULES, 2008.

  1. These Rules, thus, may be called as “THE HIGH COURT LAWYERS WELFARE FUND RULES, 2008”
  2. These rules shall come into force w.e.f. 4-9-2008

SECTION:- 2 DEFINITIONS :-

  1. ADVOCATE” : A person is an advocate if he/she :-
    1. Is enrolled as an Advocate under the Punjab and Haryana Bar Council;
    2. Is member of Punjab and Haryana High Court Bar Association;
    3. A primary place of practice at Punjab and Haryana High Court;
  2. HIGH COURT”: means the Punjab and Haryana High Court at Chandigarh;
  3. BAR COUCIL”: means the Bar Council of Punjab and Haryana at Chandigarh;
  4. WELFARE FUND COMMITTEE”: means an elected Executive Committee comprising all the elected office bearers and elected Executive Members of the Bar Association;
  5. BAR ASSOCIATION”: means the Punjab and Haryana High Court Bar Association;
  6. CHAIRMAN” means the elected President of the Bar Association by virtue of his/her office;
  7. VICE CHAIRMAN”: means the elected Vice- President of the Bar Association by virtue of his/her office;
  8. SECRETARY”: means the elected Secretary of the Bar Association by virtue of his/her office;
  9. JOINT SECRETARY”: means the elected Joint-Secretary of the Bar Association by virtue of his/her office;
  10. TREASURER”: means the elected Treasurer of the Bar Association by virtue of his/her office;
  11. WELFARE FUND”: means, the fund already created under the repealed rules. This fund will continue to be enriched through the contributions made by the members of the Bar Association, Central Government, State Government of Punjab, Haryana and U.T. Chandigarh, Individual(s), Industrial(s), Businessmen, Philanthropist and the costs imposed by the Court of law to be deposited in the name of Welfare Fund;
  12. “TRUST”: means the High Court Lawyers Public Charitable Trust already created under the repealed rules and will continue to remain in existence as “High Court Lawyers Public Charitable Trust”;
  13. INSURANCE SCHEME”: means the scheme of Accident Claim Insurance, which is already in existence, under the repealed rules.
  14. WELFARE FUND RULES”: the present rules are also called as Welfare Fund Rules;
  15. WELFARE RULES”: means the Punjab and Haryana High Court Advocate (Medical Reimbursement and Welfare) Rules, 2008.
