PUNJAB AND HARYANA HIGH COURT BAR ASSOCIATION EMPLOYEES (RECRUITMENT AND CONDITIONS OF SERVICE) RULES 2009

  1. Short Title & Commencement
    1. These rules may be called the Punjab and Haryana High Court Bar Association Employees (Recruitment and conditions of Service) Rules, 2009.

    2. These rules shall come into force from 1st June 2009

  2. Definitions: In these rules, unless the context otherwise requites:

    1. “Direct Recruitment” means an appointment made otherwise than by promotion from within the service by the Executive Committee of the Bar Association.

    2. “Executive Committee” means the elected body of the Bar which will include all office bearers and all the Executive Members.

    3. “Appointing Authority” for the purpose of these Rules, the Secretary of the Bar Association shall be deemed to be the “Appointing Authority” who shall have the sole authority to make appointment by way of Direct Recruitment on promotion upon attaining the approval of the Executive Committee with 2/3rdmajority of its total membership. This shall however not curtail the powers of the Secretary of the Bar Association to make temporary recruitment on daily wages which shall, however, not exceeds a period of 30 days.

    4. “Employee” Employee means, a person who has been validly appointed by the Executive Committee of the Bar Association.

    5. “Contractual appointment” means, an appointment made purely on contract basis for a specified period and on fixed remuneration.
